Total Panorama Virtual Tour Terms and Conditions
This is a legal agreement between Total Panorama and "You" the customer. You will be bound for the duration of any commission, which both parties agree to via telephone, email or post, by these Terms and Conditions.
All orders and requests for commissions will be subject to an acceptance from Total Panorama, Total Panorama Reserve the right to accept or decline any potential commission. This will then be notified to you when Total Panorama confirms your commission and you will then be governed by these Terms and Conditions. Any liability Total Panorama may have in contract shall be limited to the total fees paid by you under this agreement.
A full copy of Total Panoramas Terms and Conditions will be sent to you with every quotation.
Once a commission has been formally agreed by both parties, all fees are payable within thirty days from invoice date. An Invoice will be sent via email to your chosen email address, or alternatively an invoice can be posted to your chosen postal address.
Interest on overdue bills is calculated on a daily basis at 5% above HSBC advertised base rate for any amounts outstanding beyond 30 days from date of invoice.
Total Panorama reserves the right to take whatever action it may deem to be appropriate in the recovery of late payments, particularly where unreasonable behaviour is evident.
All intellectual property and provided content, with reference to any commission, shall remain the ownership of Total Panorama, until such time as full & final settlement of any agreed commission has been completed.
We take every measure to ensure all photography is completed to the fulfilment of a commission. It is then your responsibility to check all photographs and Virtual Tours provided to certify that they are correct in all requirements.
We ask that the location is prepared how the customer would like it to be photographed; you are fully responsible for the location's appearance. If the location isn't fully prepared extra costs can occur due to extra time being spent at a location.
It is your responsibility not to be late for an agreed appointment, extra cost will be applicable for the extra time spent on location due to lateness or obstruction.
You are prohibited from using any part or parts of a Total Panorama commission in conjunction with any other Virtual Tour provider, without our express written agreement.
Depending on web arrangements and on completion of a commission, you will have full responsibility of how it's uploaded, maintained and updated.
Total Panorama is not responsible nor liable to you nor to any third party for any loss of profits, loss of turnover, loss of sales, corruption of data or software and for any indirect or consequential losses by using any of our services.
It is your responsibility to ensure the user can view and operate the Virtual Tour on your website. Total Panorama cannot guarantee that any of its Virtual Tour files shall be playable on any particular computer system or browser.
When it has been agreed that Total Panorama will host a commission, this web hosting will be provided on a yearly basis for an agreed cost. Once the period of one year for the hosting has expired, Total Panorama has the right to remove the commission from our web server, unless the hosting has been agreed to continue for the required fee.
Total Panorama asks that you give at least 48hours notice prior to a cancellation or rescheduling of a commission. You will be liable for extra costs if a tour is rescheduled with less than 48hours prior notice. Total Panorama cannot guarantee a specific date for the rescheduled commission. You will be liable for the full cost of a commission if it is cancelled with less than 48hours prior notice.
You will be liable for the full cost of a commission tour if Total Panorama is unable to gain agreed access to the appropriate premises on the day of an agreed commission.
